TERMS OF HIRE

The following are terms and conditions for the DEBUT STUDIOS (ABN: 83 318 091 976) studio space. These Terms together with any other terms and conditions specified in any other documents incorporated by these Terms, form part of the contract between You and DEBUT STUDIOS. By making a booking with DEBUT STUDIOS you agree to these terms and conditions. If you do not accept these terms and conditions DEBUT STUDIOS cannot proceed with your booking.

Definitions

In these Terms:

“Building” or “The Building” means the building where DEBUT STUDIOS is located, Marlborough House, 61 Marlborough Street, Surry Hills NSW 2010

“DEBUT STUDIOS”, “We” “Our” or “Us” means Samuel F Buchanan & E Coker T/A DEBUT STUDIOS ABN 83 318 091 976.

“Equipment” means the equipment, furniture, or fittings residing in or as part of the studio.

“Props” means the hire props, plinths, paper rolls residing in or as part of the studio.

“Estimate” means any estimated costs we send You for fees in relation to Your Hire request.

“Hire Period” means the date and time You occupy The Studio until the end of the period specified in the Hire Confirmation.

“Hire Confirmation” means the final confirmation DEBUT STUDIOS send You incorporating any agreed Estimate.

“Studio” or “The Studio” means the DEBUT STUDIOS studio space at Suite 62, 61 Marlborough St, Surry Hills NSW 2010

“You” or “Your” means the person or entity entering into the agreement to hire the Studio from Us.

1.     Grant of Licence to Hire Studio

a.    In consideration of You paying the Hiring Charges, we hereby grant You a non-exclusive licence to occupy and use the Studio for the Hire Period.

b.    The rights granted to You are a non-exclusive licence only and nothing in these Terms grants You any right of tenancy or exclusive possession of the Studio.

2.     Availability

c.     DEBUT STUDIOS Studio is available to hire 7 days of the week. The Building open hours are 8am to 5:30pm. If You want to hire The Studio outside these hours, You must contact DEBUT STUDIOS when making Your booking. DEBUT STUDIOS reserves the right to charge a fee for any flexible hire times or additional hours outside of 8am to 5:30pm.

        i.         Flexible start times are charged at a $150.00+GST fee for starting any time before 7:30am or ending any time after 6:00pm.

d.    DEBUT STUDIOS is able to be hired three ways:

        i.         A Full Day consists of 9.5 hours from 8am to 5:30pm charged at $850.00+GST per day.

        ii.        A Half Day consists of 4.5 hours either in the AM, 8am to 12:30pm; or the PM, 1pm to 5:30pm charged at $550.00+GST per half-day.

        iii.        Hourly means a minimum of 2 hours at DEBUT STUDIOS hourly rate of $150.00+GST per hour.

        iv.        Additional hours can be added to Your hire by negotiation and are subject to availability. Additional hours are charged at DEBUT STUDIOS hourly rate of $150.00+GST per hour.

3.     Bookings

e.     An offer is only accepted when DEBUT STUDIOS supplies You with a corresponding Hire Confirmation via email which incorporates these Terms.

f.      DEBUT STUDIOS may choose at any time, in its sole discretion, not to hire out the Studio to You. The Studio is subject to availability.

g.    DEBUT STUDIOS may issue You with an Estimate based on Your requirements and a provisional hold will be placed on Your requested time/date to hire the Studio awaiting confirmation from You. DEBUT STUDIOS may cancel Your booking and release it to another customer if You do not confirm Your booking within a reasonable time.

h.     Request for cyc painting must be received by Us in writing at least 48 hours prior to the commencement of Your hire.

4.     Cancellations

i.       You must promptly notify DEBUT STUDIOS if You wish to cancel Your booking. Upon cancellation, the following cancellation fees apply:

       i.     Less than 24 hours prior of the Hire Date: 75% of the Hiring Charges;

       ii.     Within 2 business days of the Hire Date: 50% of the Hiring Charges;

       iii.     Within 4 business days of the Hire Date: 25% of the Hiring Charges; and

       iv.     For all other cancellations: the balance of any Hiring Charges (less a $20.00 cancellation fee) will be refunded in full.

5.     Use

j.       The Studio is to be left in the same condition as found, excluding reasonable wear and tear. If DEBUT STUDIOS determines the Studio to be in an excessively dirty condition (as determined by Us in our sole discretion), you will be charged a cleaning fee.

k.     You are responsible in taking care not to damage or mark The Studio including but not limited to walls, floors or the cycs.

l.       You are responsible for insuring Your own equipment and personal property, including that of Your clients’, associated personnel and other third party individuals.

m.   You are responsible for all loss or damage caused to the Studio by You or Your Personnel or guests (reasonable wear and tear excepted). DEBUT STUDIOS reserve the right to invoice You to recover Our costs of assessment, repair and/or restoration in accordance with these Terms.

n.     Please ensure Your public liability insurance covers You when hiring The Studio. You agree to indemnify DEBUT STUDIOS against any cost including legal costs, damages, payments, fines, or interests DEBUT STUDIOS may incur as a result of You breaching these Terms.

o.     DEBUT STUDIOS ensures The Studio is cleaned and disinfected following every standard Hire, as performed by Us.  

6.     Props and Equipment

p.    Equipment, furniture, and fittings residing in the studio are the property of DEBUT STUDIOS. Should any item be damaged due to negligence You are responsible for notifying Us. DEBUT STUDIOS reserve the right to invoice You to recover Our costs of assessment, repair and/or replacement for damaged items in accordance with these Terms.

q.    DEBUT STUDIOS hires out props including but not limited to plinths, paper rolls or backdrops. Props are subject to availability and cost is determined by Us or set out in DEBUT STUDIOS Props Pack.

r.      Props are to be returned at the end of the Hire Period in the same condition as found, excluding reasonable wear and tear. If Props are damaged due to negligence DEBUT STUDIOS reserve the right to charge You a cost of assessment, repair and/or replacement.
